This iSekurity Service Agreement ("Agreement") sets forth the terms and conditions of the iSekurity Service offered by iSekurity.
THESE ARE THE TERMS OF OUR AGREEMENT WITH EACH OTHER. ALL OF IT IS IMPORTANT SO TAKE A FEW MINUTES TO READ IT CAREFULLY. BY ENROLLING AND USING ISEKURITY'S IDENTITY’S PROTECTION SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THESE TERMS AND CONDITIONS.
THIS AGREEMENT CONTAINS AN ARBITRATION CLAUSE AND A CLASS ACTION WAIVER.
YOU UNDERSTAND THAT BY CLICKING ON THE "I ACCEPT" BUTTON BELOW, YOU ARE PROVIDING "WRITTEN INSTRUCTIONS" TO ISEKURITY, INC., CSIDENTITY CORPORATION AND THEIR EMPLOYEES, AGENTS, SUBSIDIARIES, AFFILIATES, CONTRACTORS, THIRD PARTY DATA SOURCES AND SUPPLIERS, AND ALL OTHER CREDIT REPORTING AGENCIES UNDER THE FAIR CREDIT REPORTING ACT (FCRA), AS AMENDED, TO ACCESS YOUR CREDIT FILES FROM EACH NATIONAL CREDIT REPORTING AGENCY (INCLUDING, WITHOUT LIMITATION, TRANSUNION, TRANSUNION INTERACTIVE, EXPERIAN, EXPERIAN CONSUMER DIRECT AND EQUIFAX) AND TO EXCHANGE INFORMATION ABOUT YOU WITH EACH SUCH NATIONAL CREDIT REPORTING AGENCY IN ORDER TO VERIFY YOUR IDENTITY AND TO PROVIDE THE PRODUCTS AND/OR SERVICES TO YOU.
1. Definitions
In addition to terms that may be defined elsewhere in this Agreement, as used in this Agreement, the following terms shall have the following meanings:
1.1 "Credit Restoration Expenses" means: (i) reasonable and necessary costs incurred by you in the United States for re-filing applications for loans, grants, or other credit instruments that are rejected solely as a result of an Identity Theft Incident; (ii) reasonable and necessary costs incurred by you in the United States for notarizing affidavits or other similar documents, long distance telephone calls and postage solely as a result of your efforts to report an Identity Theft Incident and/or amend or rectify records as to your true name or identity as a result of an Identity Theft Incident; (iii) reasonable and necessary costs incurred by you for up to six credit reports from established credit bureaus (with no more than two reports from any one credit bureau) dated within twelve months after your knowledge or discovery of an Identity Theft Incident; (iv) actual lost wages earned in the United States within twelve months after your discovery of an Identity Theft Incident, whether partial or whole days, for time reasonably and necessarily taken off work and away from your work premises solely as a result of your efforts to amend or rectify records as to your true name or identity as a result of an Identity Theft Incident, including remuneration for vacation days, discretionary days, floating holidays, and paid personal days, up to a maximum amount of $500 per week for four weeks, but not for sick days or any cost arising from time taken from self-employment; (v) reasonable and necessary fees and expenses incurred in the United States by you with iSekurity's consent for an attorney approved by iSekurity for defending any civil suit brought against you by a creditor or collection agency or entity acting on behalf of a creditor for non-payment of goods or services or default on a loan as a result of an Identity Theft Incident and removing any civil judgment wrongfully entered against you as a result of the Identity Theft Incident.
1.2 "Identifying Information" means any name or number that may be used, alone or in conjunction with any other information, to identify a specific person, including: (i) name, social security number, date of birth, official State or government issued driver's license or identification number, alien registration number, or government passport number; (ii) unique biometric data, such as fingerprint, voice print, retina or iris image, or other unique physical representation; (iii) unique electronic identification number, address, or routing code; or (iv) telecommunication identifying information or access device.
1.3 "Identity Theft" means a fraud committed using the Identifying Information of a Member without authority and with the intent to commit, aid, or abet any unlawful activity that constitutes a violation of federal law or any applicable state or local law as determined in iSekurity's sole and absolute discretion. Identity Theft does not include the theft or unauthorized or illegal use of your business name, d/b/a, or any other method of identifying your business activity or any unauthorized use of an existing credit or debit card.
1.4 "Identity Theft Incident" means all acts related to an Identity Theft arising from the same, related, continuous, or repeated acts, whether committed by one or more persons. All such acts shall be treated as a single Identity Theft Incident, which Identity Theft Incident shall be deemed to have occurred at the time of the first such act.
1.5 "Investigation" means iSekurity's investigation of an Identity Theft Incident in order to identify the perpetrator as further defined and described in Section 3.6(a) below.
1.6 "Investigation Start Date" means the date defined and described in Section 3.6 (a) below.
1.7 "iSekurity" means iSekurity, Inc., a Michigan corporation, having its principal place of business at 24663 Mound Road, Warren, Michigan 48091. iSekurity may sometimes be referred to as "we".
1.8 "iSekurity Service" means the iSekurity services described in Section 3 of this Agreement.
1.9 "Member" means an individual person actively enrolled in the iSekurity Service and includes a person covered under a single membership plan, and each individual covered by a double membership plan or a family membership plan. The term "you" or "your", when referring to a Member, generally includes each individual covered by an iSekurity membership plan.
1.10 "Minor Child" means a child covered under a double or Family Plan who is under the age of 18.
2. Membership Plans
General. There are 3 membership plan options, including a Single Plan, a Double Plan and a Family Plan. You must be 18 years of age or older to enroll, and you must have a primary residence in the United States and a social security number. All memberships are non-transferrable by Members. The benefits and services of the memberships are solely for the use of the identified Members.
2.1 Single Plan. The Single Plan covers one individual.
2.2 Double Plan. The Double Plan covers two people living in your household, including a child living away from home at school. The second individual in the Double Plan can be your spouse, significant other, Minor Child for whom you are the parent or legal guardian, or your child under 26 years of age.
2.3 Family Plan. The Family Plan is for immediate family members living in your household, including children under 26 years of age who are living away from home at school. The Family Plan covers 2 adults and up to 5 additional family members. If you enroll a Minor Child, you must be the parent or legal guardian. The 5 additional family members you may cover under your Family Plan include your children under the age of 26.
3. iSekurity Service
While you are a Member, iSekurity will provide the following services to you:
3.1 Education. iSekurity will educate you on how to order free credit reports, explain when, how, and why you should set a fraud alert, and teach you how to reduce junk mail and place yourself on the "do not call" list.
3.2 Fraud Warnings. You will receive regular Fraud Warnings via email from iSekurity alerting you of the latest scams.
3.3 Sekure Scansm. iSekurity will provide a Sekure Scansm report once a year for members under 26 years of age. Sekure Scansm is a proprietary system of iSekurity that reports infiltration, manipulation, and breach of a Member's Identifying Information in order to help deter and detect Identity Theft.
3.4 Support. You will have access to iSekurity's customer service representatives at the iSekurity Command Center from 9:00 AM to 9:00 PM EST, Monday through Friday for questions about enrollment or the iSekurity Service.
3.5 Wallet Identification Card, Credit Card Stickers. You will receive a personalized wallet warning card with iSekurity contact information and a warning to Identity Theft thieves that you are protected by the iSekurity Service. You will also receive warning stickers to place on your credit cards.
3.6 Identity Theft Services. If you are the victim of an Identity Theft Incident and the Identity Theft Incident occurs while you are a Member of iSekurity, iSekurity will provide the following services to you, provided that you have complied with the terms of this Agreement, including the authorizations described in Section 3.6 (b) below:
(a) Investigation. In order to start an Investigation, you must notify iSekurity through the Victim Hotline or Command Center of the Identity Theft Incident or of the event that has occurred that you believe may lead to an Identity Theft Incident, along with all of the surrounding circumstances. The notice must be in writing (which can be done following your initial phone call if you first call the Victim Hotline or Command Center) and must be made within 48 hours of your discovery of the Identity Theft Incident or the event that has occurred that you believe may lead to an Identity Theft Incident. Within 24 hours of your notification to iSekurity, one of iSekurity's security team experts will contact you to discuss the event you reported. Following such consultation and if your case manager believes that an Investigation is warranted based on the event you reported, your case manager will request you provide to iSekurity: (i) a copy of a police report filed by you; and (ii) an affidavit signed by you (in a form provided by iSekurity) in order for the Investigation to proceed. iSekurity reserves the right to cancel the Investigation if you do not provide the foregoing items within 48 hours of the request. When these items have been provided, iSekurity will notify you when it commences an investigation (the "Investigation Start Date"). Any additional Identity Thefts that occur after the Investigation Start Date and that relate to the initial event you report will be investigated under and included in the open Investigation.
(b) Authorization, Information Sharing, Limited Power of Attorney, and Additional Information. In the event the Investigation proceeds, you expressly authorize iSekurity's authorized employees to: (i) speak to parties on your behalf as required for iSekurity to provide the services related to Identity Theft; and (ii) act as your personal representative under 15 U.S.C. § 1681c-1, under which consumers or their authorized personal representatives have the right to request fraud alerts. In addition, you agree to execute a limited power of attorney (in a form provided by iSekurity) authorizing iSekurity's performance as necessary to continue the Investigation. As the Investigation proceeds, you agree to provide iSekurity any other relevant documents and/or materials requested by iSekurity. You acknowledge that iSekurity may provide your Identifying Information to third parties as part of that Investigation including, but not limited to, TransUnion, Experian, Equifax, other credit bureaus, banks, and merchants. You waive any and all claims against iSekurity for the acts and omissions of these companies with regard to the use or disclosure of such Identifying Information.
(c) Law Enforcement. iSekurity will act as your liaison with local, state, or federal law enforcement agencies in an effort to prosecute the wrongdoer(s) and assist you in recovering restitution of damages. In the event that you retain private counsel (at your cost) to pursue civil proceedings, iSekurity will cooperate with such counsel to assist in obtaining appropriate relief for you.
(d) Victim Hotline. If you are the victim of an Identity Theft Incident, you will have access to iSekurity's Victim Hotline and iSekurity's team of security experts. Our Victim Hotline is available 24 hours a day, 7 days a week to address your questions and concerns and provide help and advice.
(e) Credit Restoration Services. After receipt of authorization from you, iSekurity will provide the following credit restoration services: (i) provide you with an information package including a description of the resolution process, educational articles, and guidance for avoiding future complications; (ii) notify the three major credit bureaus and provide assistance with requesting that a fraud alert be placed on your credit files and affected credit accounts; (iii) review your credit files with you to determine the accuracy of the file and potential areas of fraud; (iv) notify, as needed, your affected creditors, financial institutions, credit card companies, utility providers, and merchants of the identity fraud; (v) provide information to the Federal Trade Commission and to other government agencies as appropriate; (vi) when appropriate, provide assistance with obtaining and reviewing your Social Security Personal Earnings and Benefits Statement; and (vii) create and maintain a case file to document the Identity Theft Incident.
(f) Reimbursement for Credit Restoration Expenses. Members are covered for Credit Restoration Expenses incurred due to Identify Theft Incidents for up to $25,000.00 in the aggregate for all Identity Theft Incidents (this coverage is pursuant to a Member endorsement to a master insurance policy issued to iSekurity from a third party insurance provider). Your benefits will be subject to all of the terms, conditions, and exclusions of the master insurance policy, a complete copy of which will be provided upon request. (g) Reverse Bounty. iSekurity will pay you a $10,000.00 reverse bounty if all of the following conditions are met: (a) iSekurity is unable to identify, within one year of the Investigation Start Date, one of the persons involved in an Identity Theft Incident; (b) you suffer an unrecoverable Financial Loss as a result of the Identity Theft Incident the Financial Loss occurs while you are a Member and have not let your membership lapse; and (c) you and those individuals covered under your membership plan are truthful with us and fully cooperate with our Investigation. "Financial Loss" means actual proven direct damages arising from an Identity Theft Incident that a Member is legally required to pay to a third party following demand of that third party for such payment. Additionally, Members are limited to, and only eligible to be paid, a maximum of one reverse bounty payment for an Identity Theft Incident, with a maximum amount of $30,000.00 per lifetime, in the aggregate, for all Identity Theft Incidents. A reverse bounty payment is not reparation for the specific amount of the Financial Loss caused by an Identity Theft Incident but is paid in full regardless of the actual amount of the Financial Loss.
3.7 Services to a Minor Child. Under a Double or Family Plan. Sekure Scan SM reports will be provided for Minor Children, however, the services described in Sections 3.1 (Education), 3.2 (Fraud Warnings), 3.4 (Consultation), and 3.5 (Wallet Identification Card and Credit Card Stickers) (collectively, the "Excluded Minor Child Services") will not be provided to a Minor Child covered under a Double Plan or Family Plan. iSekurity will provide the Excluded Minor Child Services to a Minor Child effective upon the annual membership renewal date subsequent to a Minor Child turning the age of 16. In the case of Identity Theft services, such services will be dependent upon the parent or legal guardian acting on a Minor Child's behalf.
3.8 Identity Monitoring. . iSekurity will provide you with email notifications when a change takes place in your personal or credit information. Specifically, iSekurity will monitor all three major credit bureaus, court and criminal records, the national change of address registry, social security numbers, checking and savings accounts, credit cards, driver’s licenses, medical ID numbers and non-credit loans. iSekurity will also provide you with a list of all sex offenders in your zip code. Upon receipt of an email notification, you will be asked to log into your member portal to view the specific changes to your information.
4. Your Representations About Identifying Information, Protection of Personal Information, and Identity Theft Incidents
4.1 Identifying Information. You agree that you are only providing Identifying Information about yourself and those individuals covered under your membership plan, and not the Identifying Information of any other individual. You agree that the information you provide during the registration process and any subsequent information you provide to iSekurity will be true, accurate, and current. In the event that any information you have provided iSekurity has changed you must notify iSekurity. In addition, you agree that you will not purposely engage in behavior that will put your personal information at unnecessary risk, such as leaving your PIN or passwords in obvious places or publishing your Social Security Number. You agree to comply with all applicable laws and regulations and that you are buying the iSekurity Service only for your own use as a Member and those covered under your membership plan. You agree that you are eighteen (18) years of age or older.
4.2 Truthfulness of Information. You agree that any information submitted by you to iSekurity will be true to the best of your knowledge and belief. You agree that any affidavits or forms that you submit to iSekurity will be made in good faith and will contain truthful, correct, and complete information.
4.3 Identity Theft Information. You agree that you will not intentionally misrepresent damages or commit a fraud-related crime, or misrepresent that you were a Member at the time of an Identity Theft Incident. If you do so, you agree to repay iSekurity upon demand any costs or expenses that iSekurity has incurred in connection with your claim, including without limitation, any costs iSekurity incurs for the Investigation and reasonable attorneys fees and costs incurred in order recover such costs and expenses from you (collectively, "Damages"). If you are found guilty of a crime related to the loss which you attributed to Identity Theft, it will be sufficient evidence to conclude that iSekurity is entitled to collect Damages from you, but being found guilty of such a crime is not necessary for iSekurity to collect Damages from you.
4.4 Fair Debt Reporting Act. The Fair Credit Reporting Act allows you to obtain from each credit reporting agency a disclosure of all the information in your credit file at the time of the request. Full disclosure of information in your file at a credit reporting agency must be obtained directly from such credit reporting agency. The credit reports provided or requested through our Site are not intended to constitute the disclosure of information by a credit reporting agency as required by the Fair Credit Reporting Act or similar laws.
Under the Fair Credit Reporting Act you are entitled to receive an annual free disclosure of your credit report from each of the national credit reporting agencies. To request your free annual report under the FCRA, you must go to www.annualcreditreport.com. You can also contact the central source to request this free annual disclosure by calling toll free (877) 322-8228 or by using the mail request form available at the central source Website.
You are entitled to receive a free copy of your credit report from a credit reporting agency if:
In addition, if you reside in the state of Colorado, Maine, Maryland, Massachusetts, New Jersey, or Vermont, you are entitled to receive a free copy of your credit report once a year and if you reside in the state of Georgia, you are entitled to receive a free copy of your credit report twice a year. For Illinois residents, credit reporting agencies are required by law to give you a copy of your credit record upon request at no charge or for a nominal fee. Otherwise, a consumer reporting agency may impose a reasonable charge for providing you with a copy of your credit report.
The Fair Credit Reporting Act provides that you may dispute inaccurate or incomplete information in your credit report. YOU ARE NOT REQUIRED TO PURCHASE YOUR CREDIT REPORT FROM TRUECREDIT IN ORDER TO DISPUTE INACCURATE OR INCOMPLETE INFORMATION IN YOUR REPORT OR TO RECEIVE A COPY OF YOUR REPORT FROM EQUIFAX, EXPERIAN OR TRANSUNION, THE THREE NATIONAL CREDIT REPORTING AGENCIES, OR FROM ANY OTHER CREDIT REPORTING AGENCY.
It may be the policies of Equifax, Experian and/or TransUnion to provide a complimentary copy of the consumer credit report under circumstances other than those described above. If you wish to contact Equifax, Experian or TransUnion to obtain a copy of your credit report directly from such agency or if you wish to dispute information contained in an Equifax, Experian or TransUnion credit report file, see the contact information below:
5. Service Commitment, Renewal, Cancellation, and Cancellation Fees
iSekurity requires a minimum one year service commitment. Payments may be made by a single annual payment or 12 equal monthly payments. All accounts will be automatically renewed for one year on the anniversary date of your enrollment unless you notify us otherwise in writing. All cancellations must be in writing. There is a cancellation fee of fifty ($50) dollars per Plan if you cancel within the first six (6) months of your initial enrollment. If you paid on an annual basis, iSekurity will refund a pro rata amount of unused fees, less the cancellation fee.
6. Payment Terms/Taxes
Payment for the iSekurity Service may be made by credit card or debit card. You are personally responsible for any applicable state and/or federal sales or other taxes that may be associated with the purchase of the iSekurity Service.
7. Privacy Policy
We respect your privacy. Please see our Privacy Policy on our website at www.isekurity.com and click on the appropriate button to review our Privacy Policy, the terms and conditions of which are incorporated into this Agreement. If you do not have access to the website location, please inform us so that we may provide a copy to you. You agree to accept the terms of the Privacy Policy as a condition of acceptance of this Agreement.
8. Membership Eligibility and Termination
We will determine whether or not to accept you as a Member of the iSekurity Service, and we may refuse to provide the iSekurity Service to you for any reason. If you fail to comply with any of the terms and conditions of this Agreement, iSekurity may at any time terminate your rights under this Agreement at its sole discretion and upon notice to you.
9. Disclaimers and Limitation of Liability
EXCEPT AS OTHERWISE SET FORTH IN THIS AGREEMENT, ISEKURITY MAKES NO REPRESENTATION OR WARRANTY ABOUT THE ISEKURITY SERVICE OF ANY KIND, AND ISEKURITY DISCLAIMS ANY IMPLIED WARRANTIES, SUCH AS A WARRANTY OF MERCHANTABILITY OR FITNESS OF THE ISEKURITY SERVICE FOR ANY PARTICULAR PURPOSE. INFORMATION PROVIDED BY ISEKURITY OR ITS SECURITY EXPERTS RELATING TO IDENTITY THEFT OR SECURITY ISSUES, IS INTENDED TO ASSIST MEMBERS WHO ARE VICTIMS OF IDENTITY THEFT, BUT ISEKURITY CANNOT GUARANTEE RESULTS OR OUTCOMES. IN NO EVENT WILL ISEKURITY, ITS EMPLOYEES, DIRECTORS, OFFICERS, INVESTORS, AGENTS, OR REPRESENTATIVES BE LIABLE FOR YOUR USE OF THE ISEKURITY SERVICE, RESULTS OF DECISIONS MADE OR ACTIONS TAKEN BASED UPON YOUR USE OF THE ISEKURITY SERVICE, OR ANY FAILURE TO TAKE ACTION, OR ANY THIRD PARTY CLAIM MADE AS A RESULT OF YOUR USE OF THE ISEKURITY SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ISEKURITY, ITS EMPLOYEES, DIRECTORS, OFFICERS, INVESTORS, AGENTS, OR REPRESENTATIVES BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, ARISING OUT OF THE SERVICES OR THE PERFORMANCE OF THIS AGREEMENT, WHETHER BASED ON ACTIONS IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ISEKURITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EXCEPT AS PROVIDED BY THE EXPRESS TERMS OF THIS AGREEMENT, IN NO EVENT WILL ISEKURITY'S CUMULATIVE LIABILITY UNDER THIS AGREEMENT EXCEED THE AMOUNT OF MEMBERSHIP FEES YOU HAVE PAID FOR YOUR MOST RECENT MEMBERSHIP YEAR.
YOU ACKNOWLEDGE THAT THE PROVISIONS OF THIS SECTION 9 ARE A MATERIAL FACTOR IN ISEKURITY'S DETERMINATION OF THE FEES FOR THE ISEKURITY SERVICE AND THAT THE SAME FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN THE PARTIES.
10. Arbitration
Both you and iSekurity agree that any dispute, controversy or claim arising out of, or relating to, any interpretation, construction, performance or breach of this Agreement or the services provided under this Agreement shall be settled by binding confidential arbitration in Oakland County, Michigan in accordance with the American Arbitration Association's ("AAA") Commercial Arbitration Rules (including without limitation the Supplementary Procedures for Consumer-Related Disputes) then in effect. The arbitrator may grant injunctions or other relief in such dispute or controversy. A single arbitrator with knowledge of electronic commerce shall conduct the arbitration and the parties shall mutually agree upon such arbitrator. In the event that the parties have not agreed on an arbitrator within thirty (30) days of the date of the notice of intention to arbitrate, the arbitrator shall be selected by AAA from its list of commercial arbitrators. The decision of the arbitrator will be final, conclusive and binding on the parties to the arbitration. Judgment may be entered on the arbitrator's decision in any state or federal court. The cost of the arbitrator will be shared between you and iSekurity (i.e., iSekurity shall pay one half and the Member or Members shall pay the other half). All other expenses of arbitration will be paid by the party incurring the expense. This Agreement shall be governed by the laws of the State of Michigan, without regard to any Michigan laws that would direct the choice of another state's laws and, where applicable, to be governed by the federal laws of the United States.
11. Indemnification
You agree to indemnify and hold iSekurity, its affiliates, and all of their agents, directors, officers, investors, employees, information providers, and licensors and licensees harmless from and against any and all liability and costs (including reasonable attorneys' fees and costs) incurred by any of them in connection with any claim arising out of any breach by you of this Agreement.
12. Trademarks, Copyrights, and Restrictions
The iSekurity names, marks, and logos are trademarks of iSekurity and may not be used without the prior written permission of iSekurity. Everything you see in any promotional materials is copyrighted by iSekurity unless otherwise specified. All other product names and company logos found on promotional materials are the trademarks of their respective owners. All promotional materials are protected by copyrights, which are owned or licensed by iSekurity. You may not reproduce, perform, create derivative works from, republish, upload, post, transmit, or distribute in any way whatsoever any iSekurity information without the express, written consent of iSekurity.
13. Credit Repair
iSekurity is not a credit repair organization. iSekurity cannot improve your credit history or credit rating. iSekurity will not provide you with advice or assistance in improving your credit history or credit rating.
14. Entire Agreement
This Agreement, our Privacy Policy and the Subscription Agreement represent the entire understanding between you and iSekurity regarding your relationship with iSekurity and supersede any prior statements or representations. You may not alter, supplement, or amend these Agreements and any attempts to do so will be null and void. You should print and retain a copy of these Agreements for future reference.
15. Amendment or Change of Terms
We may revise this Agreement at any time, in our discretion. However, we may not make any changes retroactive. We will notify you of any changes at the email address associated with your account, and by publishing details of those changes by including them in the terms and conditions published on iSekurity's website. If you do not contact iSekurity and express your objection to our changes within fifteen (15) days of receiving this notice, you shall be deemed a continuing use client and agree to be bound by any such revisions. If you do not agree to be bound by those changes, you should not use the services offered under this Agreement and should cancel your membership. If you use the services provided under this Agreement after iSekurity has notified you of any changes in this Agreement, you agree to be bound by those changes immediately and waive the fifteen (15) day notice period.
16. Miscellaneous
The section headings used herein are for convenience of reference only and do not form a part of this Agreement, and no construction or inference will be derived therefrom. If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable and shall not affect the enforceability of any other provision. iSekurity shall not be liable for any failure or delay resulting from fire, explosion, flood, storm, act of God, government acts, orders or regulations, hostilities, civil disturbance, strike, labor difficulties, machinery breakdown, internet or telecommunications failure, or any other similar event beyond the reasonable commercial control of iSekurity.
